1. DESCRIPTION/ENTRY PERIOD: The TOPPS “SPEED RACER” Sweepstakes (the “SWEEPSTAKES”) sponsored by THE TOPPS COMPANY (“TOPPS”) (“Sponsor”) begins on March 1, 2008 12:00:01 AM ET (Eastern Time) and ends on June 30, 2008 11:59:59 PM ET (the “Promotion Period”). Sponsor is the official timekeeper for this promotion. You may enter this Sweepstakes solely via the online method as described below.
2. ELIGIBILITY: This Sweepstakes is open to legal U.S. residents (excluding Puerto Rico and U.S. Territories) six years of age or older only at time of entry. Employees, officers, directors (including immediate family members and members of the same household) of the Sweepstakes Entities, their parents companies, affiliated and subsidiary companies, advertising and promotion agencies, legal and financial advisors and any and all other companies associated with this Sweepstakes are not eligible to participate. For purpose of the foregoing "immediate family" means parents, spouses, children, siblings or any members of the same households of such employees and directors. This Sweepstakes is void in Puerto Rico, all US territories and where restricted or prohibited by law. This Sweepstakes is subject to all applicable federal, state, local laws and regulations.
3. HOW TO ENTER: : Go to www.candytracks.com anytime during the Sweepstakes Entry Period. The first time you visit the “Speed Racer” game site, you will be asked to provide your date of birth and create a unique user name and password. If you are between 6 and 12 years of age, you will be asked to enter your parent or legal guardian’s e-mail address. If you are 13 years of age or older you will be asked to provide your own email address. Limit one user name per eligible person. Your user name and password can be used each time you come to the candytracks.com site to play “Speed Racer” games. There are five (5) games available to play: Juicy Drop Pop® Falls, Push Pop® Peak, Baby Bottle Pop® Derby, Ring Pop® Rally and Bazooka® Bubble Juice Bonanza. All games will be open to all users immediately upon registering.
After your first game play is completed, you will be asked if you want to register for the Sweepstakes. If you are 13 years of age or older and wish to enter the Sweepstakes click “Yes” to register and complete the Official Online Registration Form. Entrants must fill in all required fields. If you are between 6 and 12 years of age, click “Yes” and an email will be sent to your parent or legal guardian asking them to complete the Official Online Registration Form. An entrant between 6 and 12 years of age must have the consent of his/her parent or legal guardian to be registered for and enter the Sweepstakes. By completing the entry form, you and/or your parent or legal guardian are agreeing to be notified if you are chosen as a potential winner in this Sweepstakes.
Once you have registered for the Sweepstakes you can earn up to five (5) Sweepstakes entries per user per day for each completed game play for any combination of games played from each of the five (5) available games. For example, a user could play the Bazooka® Bubble Juice Bonanza game five (5) times in one day and earn all five (5) Sweepstakes entries for that user for that day. A user could continue to play games on the site but would not earn additional Sweepstakes entries that day after the five (5) daily game plays have been recorded. For purposes of this Sweepstakes a day is defined as the 24-hour period from 12:00:00 AM ET through 11:59:59 PM ET. For players between 6 and 12 years of age, a record will be kept of game plays per day but these game plays will not be counted as Sweepstakes entries until a parent or legal guardian has given their consent for them to participate in the Sweepstakes and completed the registration process.
Entries not complying with all rules are subject to disqualification. Use of any automated entry software is prohibited. Sponsor assumes no responsibility for incorrect or inaccurate entry information, human error or technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any computer equipment or software, or any combination thereof, or for lost, stolen, late, illegible, misdirected, entries or mail.
4. PARENT/LEGAL GUARDIAN PERMISSION: For entrants aged 6 to 12, an email will be sent to the parent/legal guardian email address provided when the entrant sets up their user name and password. Parent/legal guardian of the entrant (child) will be given the opportunity to consent or decline their child’s participation into the Sweepstakes. To consent to your child’s participation in the Sweepstakes complete the online form (via link provided in the email) requesting name of parent/legal guardian, child’s complete name, address, city, state, ZIP, telephone number, parental permission to participate in this Sweepstakes and child’s date of birth. A child’s sweepstakes entry will not be considered valid until the parent/legal guardian has completed the verification process on behalf of the child. Once the parent/legal guardian completes and submits the online form the parent/legal guardian will receive a second confirmation email confirming their child’s entry status. Parent/legal guardian of the entrant will be given the opportunity a second time to prohibit the entrant from entering the Sweepstakes by having the entrant’s registration and personal information removed with the exception of the user name and parental email address for use in logging into the site. Should a parent or legal guardian request to have an entrant removed from the Sweepstakes, that entrant will receive a message upon their next log on to the site stating they are not eligible to enter the Sweepstakes. A parent/legal guardian can prohibit an entrant from entering the Sweepstakes at any time during Promotion Period by clicking on the link provided in one of the two parent/legal guardian emails they may receive. Users who are not eligible to enter the Sweepstakes will still have access to the play the “Speed Racer” Games at the candytracks.com website. Parents/legal guardians of entrants who have questions or concerns regarding Sponsor’s use of an entrant’s personal information should review Sponsor’s Privacy Policy at

5. DRAWING AND NOTIFICATION: A random drawing will be held on or about July 15, 2008, from among all eligible online entries received. Drawing will be conducted under the supervision of Marden- Kane, Inc., an independent judging organization whose decisions are final and binding on all matters relating to this Sweepstakes. The Potential Grand Prize winner will be notified by overnight delivery on or about July 18, 2008. The parent or legal guardian of potential Grand Prize winner will be required to execute and return an Affidavit of Eligibility/Liability Release and unless prohibited by law, a Publicity Release, all of which must be completed, signed, notarized and returned within seven (7) days from date on which the documents are sent to the potential winner’s parent/legal guardian. Failure to comply within this time period may result in disqualification and selection of an alternate winner, time permitting. Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner, time permitting. Grand Prize winner and winner’s guests (parent/legal guardian of minor winner and of minor guests) must execute a Liability/Travel Release and, where legal, Publicity Release prior to the issuance of travel documents. Parents or legal guardians of winner and all guests further grant to Sponsor, defined herein, the right to use and publish their child’s proper name and/or likeness, online and in print or in any other media for advertising and promotional purposes worldwide, and in perpetuity without additional compensation unless prohibited by law.
6. SWEEPSTAKES PRIZES: Grand Prizes: One (1) Grand Prize Winner will receive a trip to a race in Charlotte, North Carolina on or around October 11, 2008 for winner and three (3) guests. Grand Prize includes roundtrip coach air transportation for winner and three (3) guests from major U.S. airport closest to winner’s residence to Charlotte, North Carolina, transfers to/from the airport/hotel and hotel/race track, hotel accommodations (two rooms, double occupancy) for 4-days/3-nights and four (4) race entry tickets, pit passes, Memory Lane Museum passes and VIP hospitality. Winner & guests must meet and follow all track regulations and requirements, and must also be available to travel on dates on or around October 9 – October 12, 2008, and on the flights specified by Sponsor or forfeit the prize. If winner or any guest traveling with winner is under the age of 16, winner must forfeit certain portions of the prize due to track rules and regulations pertaining to age restrictions associated with access to certain areas of the race track. Minors must be accompanied by an adult at all times. Tickets may be subject to standard rain check policies and procedures established by issuer and are subject to terms & conditions by the issuer. If Grand Prize Winner resides within a 200-mile radius of Charlotte, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for difference in prize value. Travel must be made through Sponsor’s agent and on a carrier of Sponsor’s choice and must be taken as designated by Sponsor or prize will be forfeited and Sponsor will have no further obligation(s) to Grand Prize Winner. Grand Prize Winner and parent/legal guardian and guests (if applicable) must travel on same itinerary and provide travel documents suitable for travel. Other restrictions may apply. Grand Prize Winner, parent/legal guardian and guests of Grand Prize Winner must execute and return a liability/travel release and, where legal, Publicity Release prior to travel. If a minor, the winner’s parent/legal guardian must legally be able to execute liability/publicity release(s) for guest(s) prior to travel to the extent guest(s) cannot legally consent to liability/publicity release. Complete terms and conditions of Grand Prize will be furnished with prize notification. Any expenses not specifically stated herein are the sole responsibility of the winner or parent/legal guardian if a minor. Approximate retail value of Grand Prize (ARV) $10,000. Odds of winning depend upon the total number of eligible entries received by the deadline date. All prizes won by a minor will be awarded in the name of the parent/legal guardian. Prizes are nontransferable. No substitutions or cash equivalents will be allowed except by Sponsor who reserves the right to award a prize of comparable or greater value if advertised prize is unavailable. All taxes, fees, and any incidentals and other expenses not specified herein including, without limitation, income taxes associated with the prize and its receipt are the sole responsibility of the winner or the parent or legal guardian of if prize won by a minor. Total value of all Sweepstakes prizes $16,323.90.
7. PRIZE RESTRICTIONS: Taxes, if any, are solely the responsibility of the winners. By entering, entrants agree to be bound by these rules, and consent to use of their names and/or photographs for advertising or publicity purposes without further consideration, except where prohibited by law. Winners release Sponsor, Administrator, Warner Brothers and UPROAR! Youth Marketing, their respective employees, directors, officers and agents, and subsidiary and affiliated companies from any and all claims or liability in connection with participation in this Promotion, or acceptance or use of any prize. In the event Grand Prize is not available for any reason whatsoever, including but not limited to scheduling conflicts, cancellations, postponements, an event of force majeure, or for any other reason, then the remaining components of the Prize shall constitute full satisfaction of Sponsor’s prize obligation to the Prize winner, and no other or additional compensation will be awarded. No assignment, transfer, conversion to cash or cash redemption, or substitution of the Prize is permitted, except Sponsor reserves the right to substitute the Prize with an age appropriate prize of comparable or greater value should the Prize become unavailable. Prize is solely for personal use and may not be used in conjunction with any other promotion. In the event that the race is cancelled or postponed for any reason whatsoever, the balance of the prize will be awarded in full satisfaction of prize award. Tickets to the event are subject to certain terms and conditions as specified thereon. Seat locations will be determined by Sponsor who also reserves the right remove or to deny entry to the winner and/or his/her guests who engages in a non-sportsmanlike or disruptive manner, or in any way to annoy, abuse, threaten or harass any other person at the event or elsewhere in the vicinity. All prize details are at the sole discretion of the Sponsor. Any and all guarantees and warranties for merchandise prizes are subject to the manufacturers’ terms and conditions, and winner(s) agrees to look solely to such manufacturers for any such warranty or guarantee claim.
8. INTERNET: If for any reason this Promotion is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor also reserves the right to disqualify any individual who is suspected of tampering with the entry process, including by not limited to creating more than one user name to participate in the Game. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, printing, typographical or other human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrants or any other person’s computer relating to or resulting from participation in this Promotion or downloading any materials in relating to this Promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Entry can only be made via one e-mail address per person. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
9. GENERAL CONDITIONS: U.S. law governs this sweepstakes. Entrants agree that all disputes shall be governed by the laws of the State of New York. All entrants also agree (i) to be bound by all applicable U.S. laws and regulations and abide by the terms of these Official Rules and the decision of the Sponsor and judges, which are final and binding on all matters relating to this Sweepstakes, (ii) to waive any right to claim ambiguity in the rules, and (iii) to release, indemnify and hold harmless the TOPPS COMPANY and each of its respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the “TOPPS Entities”), UPROAR! Youth Marketing, and their respective affiliates, subsidiaries, retailers, agents, representatives, promotion and advertising agencies including Marden-Kane, Inc., and their respective employees, officers, directors, shareholders and agents (collectively, the “Releasees”) from and against any injuries losses, damages, claims, actions, liability of any kind resulting or arising from participation in the Sweepstakes and/or acceptance, possession, use, misuse or nonuse of any prize (including any travel or travel-related activity thereto) that may be awarded. Sponsor is not responsible for any incorrect or inaccurate entrant information, whether caused by human errors or omissions, natural disasters, data transmissions or any other means; is not responsible for contacting any participant by any means if that participant has changed contact information and fails to provide Sponsor with the new contact information. THE TOPPS ENTITIES WILL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CLAIM ARISING IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES OR ANY PRIZE AWARDED.
